The current scenario of on-going skill shortages across a number of industry has resulted in Australian employers to seek out aptly competent personnel from overseas or highly skilled temporary residents currently in Australia to fulfil current contracts or to meet new business commitments. Employer Nomination Scheme (ENS) grants permanent residence to overseas workers who are sponsored by their Australian employer.

Employer Nomination Scheme visa application process is a two-stage process:

Stage 1 - 186 Nomination by the employer

Stage 2 - 186 Visa application

Eligibility requirements:

• Employee should be under the age of 45
• Have required skills, qualifications, and/or licences or registrations to satisfy the job needs.
• Meet English language requirement. Exemption from the English requirement, if you are a passport holder of the following countries: United Kingdom, United States, Canada, New Zealand or the Republic of Ireland
• Business must be actively and lawfully functioning in Australia
• Must have a genuine need to fill a skilled position
• Full-time employment contract for at least two years
• Pay market rate salary should be offered
• Business has no adverse information
• Health and character requirement is must
• Meet additional norms of the stream in which you are applying for

Once the nomination has been accepted, the visa application must be lodged within six (6) months. This visa allows the applicant and any dependent family members included in the visa application to live as permanent residents in Australia.

Streams under 186 Visa

• Direct Entry stream – Obtain a positive skill assessment and have three years post-qualification work experience in your nominated occupation
• Transition stream –Applicants who have worked for the same sponsor and in the same occupation for 3 years
• Labour agreement stream – Currently working, or will work, for an employer under a labour agreement. Sponsored by an employer through a negotiated formal labour agreement.

The processing time for this visa is between 3-6 Months approx.
